Chaiz is an online marketplace where you can search, compare, and purchase vehicle protection products, including Vehicle Service Contracts ("VSCs") and other coverage products we may offer from time to time (collectively, "Products"). VSCs are not "auto warranties" as defined under federal law but do provide coverage for certain vehicle repairs or services.
Chaiz acts as the seller of Products through our Website. The actual coverage, claims processing, and servicing is provided by the relevant product provider ("Provider" or "Administrator"). Payment plan administration is handled by a separate payment plan company ("Payment Plan Provider"). Chaiz is not responsible for claims decisions, coverage disputes, or payment processing by these third parties.
Your purchase of a Product is subject to the terms of the contract between you and the Provider, and, if applicable, a payment plan agreement with the Payment Plan Provider (each, a "Separate Agreement"). In the event of a conflict between these Terms and any separate agreement, the sseparate agreement shall control.
The Products available to you depend on your vehicle's make, model, year, mileage, and your state of residence. As you provide more specific information (such as your exact odometer reading or Vehicle Identification Number), certain offerings may become unavailable based on your vehicle's specific details or history. Where your exact vehicle details differ from your initial search parameters, we will attempt to match you with the closest available alternative to your original selection. You can then choose to proceed with the alternative or explore other options. Products are not available for purchase through our Website in all states.
In states where we do not offer direct purchase, or alongside our own results in any state, we may display offerings from third-party partners. See Section 5 for details.
We rely on the availability of third-party websites and the general performance of the worldwide web. At certain times some, or all online quotes and prices may not be displayed to you due to problems with third-party websites and/or the worldwide web.
Our Website may display recommendations, ratings, coverage comparisons, or labels such as "best value" to help you evaluate your options. These are based on a proprietary analysis of coverage terms, contract language, provider track record, and other factors. Our recommendations do not constitute a guarantee of any product, outcome, or level of service. While we strive to provide as comprehensive and easy-to-use a service as possible, the requirements for your quote or offer may not be met if they are unusual, "non-standard" or "high risk".

We do not charge fees for accessing or browsing our Website. Fees apply only when you purchase a Product.

If you update your contact details, vehicle information, or other personal information through your account, we will share those updates with the relevant Provider and Payment Plan Provider as necessary to service your contract.
You are responsible for the accuracy of the information you provide when requesting a quote or purchasing a Product. If you provide inaccurate information (for example, an incorrect odometer reading or failure to disclose pre-existing vehicle conditions), the Provider may deny claims, cancel your coverage, or take other action in accordance with the terms of your separate agreement. Chaiz is not liable for any consequences arising from inaccurate information you provide.
It is also your responsibility to review the Vehicle Service Contract you receive after purchase and confirm that all information (including vehicle details, coverage terms, and personal details) is accurately reflected. If you identify any discrepancies, contact us promptly at [email protected] so we can work with the Provider to correct them.
When you purchase a Product through our Website, we share your information (including your name, contact details, vehicle information, and payment information) with the relevant Provider and Payment Plan Provider so they can fulfill your purchase and service your contract. By providing your phone number, you acknowledge it will be shared with the Provider and Payment Plan Provider for servicing purposes, including communications regarding claims, missed payments, and contract administration.
You understand that these third parties may retain your information in accordance with their own privacy policies, regardless of whether you complete a transaction.

By providing your contact information on our Website, you agree that we may contact you by telephone or email regarding our services, including to verify your information, confirm your interest, and provide customer support. Phone calls may be recorded for quality and compliance purposes; you will be notified at the start of any call that may be recorded.
If you provide your contact details to one of our partners and consent to being contacted about vehicle protection products, we may also reach out to you by phone or email on that basis.
When you purchase a Product through our Website, you enter into a separate agreement with the Provider. Chaiz facilitates the transaction but is not a party to the Product contract or seperate agreement. You are responsible for reviewing the full terms of the Product before completing your purchase.

If you choose a monthly payment plan, your payment card details are transmitted to the Payment Plan Provider, who will process your recurring monthly payments. The total cost, number of payments, and monthly amount are disclosed to you before you complete your purchase.

If you stop making payments, your coverage will be canceled (or suspended) by the Payment Plan Provider, and the Provider will not cover claims while your account is not current. This is in accordance with the terms of your separate agreements with the Provider and Payment Plan Provider.
You may cancel your Product at any time through your account at app.chaiz.com. All cancellations are processed through the client area to ensure your intent is confirmed and any applicable actions (including potential refunds) are processed correctly.
A 30-day money-back guarantee applies to all Product purchases. If you cancel within 30 days of your purchase date, you will receive a full refund.
If you cancel after the initial 30-day period, refund eligibility depends on your payment method and the terms of your Separate Agreement with the Provider. Monthly payment plan customers are not eligible for a refund after the 30-day period. Customers who paid in full may be eligible for a pro-rated refund as determined by the Provider, subject to the terms of the separate agreement.

After purchasing a Product, you will receive access to a client area at app.chaiz.com. You can use this area to manage your contract, update your information, change your payment method, access your referral link, or cancel your coverage. Access is provided via a secure magic link sent to your email address. You are responsible for maintaining the security of your email account.

You and Chaiz each agree to resolve any dispute, controversy, or claim ("Claim") arising out of or relating to these Terms of Use, your use of the Website, or the Products purchased through the Website, by binding arbitration rather than in court.
Arbitration shall be conducted by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration will take place in Austin, Texas, unless you and Chaiz agree otherwise or the AAA determines a different location is appropriate. You may also elect to participate by telephone or video conference.
Chaiz will pay all AAA filing and arbitration fees for Claims up to $10,000. For Claims above $10,000, fees will be allocated in accordance with the AAA Consumer Arbitration Rules. Each party is responsible for its own legal fees unless the arbitrator awards them to the prevailing party.
ALL CLAIMS SHALL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, OR CONSOLIDATED ARBITRATION. THIS MEANS YOU CANNOT BRING OR PARTICIPATE IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THIS WAIVER APPLIES TO THE FULLEST EXTENT PERMITTED BY LAW.
Either party may bring an individual claim in small claims court if the claim qualifies under that court's jurisdictional limits.
Notwithstanding the above, Chaiz may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or prevent irreparable harm.
TO THE EXTENT PERMITTED BY LAW, YOU AND CHAIZ EACH WAIVE THE RIGHT TO A TRIAL BY JURY IN ANY PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS.
To the extent permitted by applicable law, you agree to indemnify and hold harmless Chaiz and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Website.
